Privacy Statement

medEATerraneo, Hauptstrasse 62, 4102 Binningen (CHE-406.250.804), represented by Dan Frey (Managing Director), operates the smvvl.ch website, and is therefore responsible for ensuring that all data processing complies with Swiss data protection legislation. We take data protection seriously and have the corresponding security measures in place. We naturally comply with the provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP), and the Telecommunications Act (TCA). Where applicable we also abide by other provisions under data protection legislation, specifically the European Union's General Data Protection Regulation (‘GDPR’). We ask you to read and to note the following information so that you know what personal data we collect from you, and what we use that data for.

1. What personal data is collected, processed. and used, and for what purpose?

1.1 when visiting www.smvvl.ch

When you visit our website, our servers store each access temporarily in a log file. The following information is stored in this case: IP address of the computer requesting access date and time of access name and URL of the file that is retrieved website from which our website was accessed your computer's operating system, and the browser you use country from which you have accessed our site, and your browser language settings name of your internet access provider This data is collected and processed to enable you to use our website (i.e., to establish a connection), to ensure ongoing system security and stability, to optimize our web presence, and for internal statistical purposes. This constitutes our legitimate interest in processing your data, as described in Article 6, paragraph 1, letter f GDPR. The IP address is used specifically to record the country in which the user is presently located and to pre-set the website language accordingly. In the event of an attack on the www.bnb.ch network infrastructure, the IP address is also analyzed for statistical purposes. 1.2 When you use our contact form

You have the option of using a contact form to contact us. The mandatory entries are marked. If this information is not provided, it may hinder the provision of our services. Providing other information is optional and has no influence on the use of our website. We only use this data to be able to answer your contact request in the best possible and personalized way. We have a legitimate interest in processing your contact request within the meaning of Article 6 Paragraph 1 Letter f of GDPR. You can object to this data processing at any time (contact details see Section 11).

1.3 When you subscribe to our newsletter

You have the option of subscribing to our newsletter on our website. Registration is required for this. When registering, you only need to provide your email address; this is necessary for data processing. By registering, you give us your consent to process this data for the regular sending of the newsletter to the email address you provided and for the statistical evaluation of usage behavior and optimization of the newsletter. This consent serves as the legal basis for us to process your email address within the meaning of Article 6 paragraph 1 letter a of the GDPR. 1.4 When you inquire or book with a third party, whether you create a guest profile or not

On our website you have various options for making enquiries or binding bookings with or without creating a guest profile. You will be informed accordingly that the enquiry/booking will be forwarded to our hosts. Depending on the service, various data will be collected in this context. If this information is not provided, it may hinder the provision of the booking services. Providing other information is optional and has no influence on the use of our website. The data you enter is usually forwarded directly. The data protection regulations of the respective provider apply to the further processing of this data, which is only lawful if it is necessary for the fulfillment of a contract within the meaning of Article 6 Paragraph 1 Letter b GDPR. Our website and applications are not aimed at children under 16 years of age, and we do not knowingly collect personal data from children under 16 years of age. For convenience and to provide a detailed quote, children traveling with you and their ages may be transmitted to the hosts at the end of the booking process. This data transmission can be avoided by contacting us by telephone. If you believe that we are processing a child's personal data inappropriately, we take this very seriously and ask you to contact us.

1.5 When you use our payment service

The entity responsible for the payment services must collect the following information, which is necessary for the proper performance of the contract and compliance with applicable laws (e.g. anti-money laundering regulations). Without this information, the payment services cannot be used: bank account, credit card or mobile pay mobile number.

2. Use of Your Data for Marketing Purposes

2.1 Creation of pseudonymized usage profiles

In order to provide you with personalized services and information on our website (on-site targeting), we use and analyze the data we collect about you when you visit the website. Cookies may also be used during the corresponding processing (see section 3). The analysis of your user behavior can also lead to the creation of a so-called usage profile. The usage data is only merged with pseudonymized, but never with non-pseudonymized personal data. In order to enable personalized marketing in social networks, we integrate so-called remarketing pixels from Facebook and Twitter on the website. You can make settings related to advertising in your user profile in the respective social networks. The creation of pseudonymized user profiles for advertising and analysis purposes represents our legitimate interest within the meaning of Article 6 paragraph 1 letter f GDPR. This applies to all data processing operations listed under section 2. The legitimate interest lies in direct marketing and the analysis of the use of our website.

2.2 Retargeting

We use retargeting technologies on the website. Your user behavior on our website is analyzed so that we can then offer you individually tailored advertising on partner websites. Your user behavior is recorded pseudonymously. Most retargeting technologies work with cookies (see section 3). This website uses Google Ads, services of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter "Google") to display ads based on the use of previously visited websites. The information generated by the cookie about visits to these websites (including your IP address) is transferred to a Google server in the USA and stored there (for more information on the transfer of personal data to the USA, see section 9). Google will use this information to evaluate your use of the website with regard to the advertisements to be placed, to compile reports on website activity and advertisements for website operators and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties if this is required by law or if third parties process this data on Google's behalf. We also use Google Tag Manager to manage usage-based advertising services. The Tag Manager tool itself is a cookie-free domain and does not collect any personal data. Rather, it triggers other tags which in turn may collect data (see above). If you have deactivated something at domain or cookie level, this will remain in place for all tracking tags implemented with Google Tag Manager. You can prevent retargeting at any time by rejecting or deactivating the relevant cookies in the menu bar of your web browser (see section 3). You can also request an opt-out for the other advertising and retargeting tools mentioned above via the Digital Advertising Alliance website at optout.aboutads.info.

3. Cookies

Cookies are information files that your web browser stores automatically on your computer's hard drive when you visit our website. Cookies do not damage the hard drive, neither do they transmit personal data about the user to us. We use cookies to tailor the information, offers and advertising you see more closely to your individual interests. Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer, or so that you are always notified when you get a new cookie. 4. Tracking tools

We use a variety of tracking tools on our website. These monitor how you move through the site. We use this information to design the website around user needs and to optimize it continually. To do this, we use pseudonymized usage profiles and cookies.

5. Social Media Plugins

The social media plugins described below are used on the website. Their default setting is deactivated, so they do not transmit any data. You activate these plugins by clicking on the relevant social media button. When they are activated, your browser establishes a direct connection with the servers of the social networks in question as soon as you call up one of our webpages. 5.1 Social media plugins from Facebook

Our website uses Facebook social plugins to make our web presence more personal. To do this, we use the LIKE and SHARE buttons. This is a service from the United States-based Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. By embedding the plugins, Facebook receives the information that your browser has retrieved a particular page on our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there. The information is also published on Facebook and shown to your Facebook friends. 6. Evaluation of Newsletter Usage

We use third-party email marketing services to send our newsletter. Our newsletter may contain technical services. 7. Forwarding of Data to Third Parties

We will only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship between you and medEATerraneo. In addition, we pass on your data to third parties if this is necessary in the context of using the website to provide the services you have requested and to analyze your user behavior. 8. Notice on the Transmission of Data to the USA

For the sake of completeness, we would like to point out to users residing or based in Switzerland that the US authorities can take surveillance measures under US law that allow the general storage of all personal data transferred from Switzerland to the USA. This is done without differentiation, restriction or exception based on the objective pursued and without an objective criterion that makes it possible to restrict the US authorities' access to the data and their subsequent use to very specific, strictly limited purposes that can justify the interference associated with both access to this data and its use. We would also like to point out that in the USA there are no legal remedies available to the data subjects from Switzerland that would allow them to access the data concerning them and to obtain its correction or deletion. There is no effective judicial protection against general access rights of US authorities. We explicitly draw your attention to this legal and factual situation so that you can make an informed decision as to whether you consent to the use of your data. We also point out to users residing in an EU member state that, from the perspective of the European Union, the USA does not have an adequate level of data protection - due, among other things, to the issues mentioned in this section. To the extent that we have explained in this data protection declaration that recipients of data (such as Google and Facebook) are based in the USA, we will ensure that your data is protected at an appropriate level by our partners either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield.

9. Your Rights

You have the right to receive information about the personal data we store about you free of charge upon request. In addition, you have the right to correct incorrect data and the right to delete your personal data, provided that this does not conflict with any statutory retention period or a legal basis that allows us to process the data. According to Articles 18 and 21 of the GDPR, you have the right to request a restriction of data processing and to object to data processing. In addition, according to Article 20 of the GDPR, you have the right to receive the personal data concerning you that you have made available to us in a common format and to have this data transmitted directly by us to a third party of your choice (right to data portability). You can contact us for the aforementioned purposes via the email address info@medeaterraneo.ch. In order to process your requests, we may, at our own discretion, request proof of identity. You can also tell us what should happen to your data after your death by giving us appropriate instructions. If you are resident in an EU country, you have the right to complain to a data protection supervisory authority at any time.

10. Data Security

We use suitable technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. You should always treat your payment information confidentially and close the browser window when you have completed a booking/order on our website, especially if you share the computer with others. We also take internal company data protection very seriously. We have obliged our employees and the service providers we commission to maintain confidentiality and to comply with data protection regulations.

11. Data Storage

We only store personal data for as long as it is necessary to use the tracking, advertising and analysis services mentioned above within the scope of our legitimate interests; to carry out services that you have requested or for which you have given your consent to the extent mentioned above (e.g. for the newsletter in accordance with section 6); to comply with our legal obligations. We store contract data for longer because it is subject to statutory retention periods arising from accounting and tax regulations. According to these regulations, business communications, concluded contracts and booking documents must be stored for up to 10 years, or up to 5 years for users residing in France. If we no longer need this data to provide the services to you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.
